Hello again to those I saw in Charleston over the weekend, and hope to see you next time to those who weren’t able to make it!
While I return to California and get settled in again, it seems that some are leaving the state for good, and the hostile business climate is why. This includes the punitive Amazon Tax which has made it impossible for Amazon and others to host affiliate programs in California, destroying small businesses, slashing profits, and killing jobs. And this is a story we’re seeing again and again, up and down the state. New and higher taxes, even of the unconstitutional variety, kills jobs.
So my message to Tennessee’s Governor Haslam is don’t do it. Don’t be like us. Create a job-friendly environment, or you will only compound whatever revenue problems you have.

Anonymous and its associated online criminal organizations continue to face losses. A top Lulzsec leader was arrested in Scotland. Remember, this guy is no “activist.” He stole from people who happened to have Visas or MasterCards. Vigilante action against Anonymous and its online criminal wings continues, as well.
Anonymous is in such trouble, they’re now desperate for allies, begging unions to join their cause. Note that by targeting Paypal, Anonymous threatens the livelihoods of many who depend on income via Paypal simply to stay in business and pay bills.

This week I already called upon Rick Perry to veto the Texas Amazon Tax, and now I’m left to hope that California Democrats will be less stupid than Joe Straus. Sigh.
Meanwhile the posturing around the AT&T/T-Mobile deal continues. We find from a press conference with COMPTEL CEO Jerry James that the Rural Cellular Alliance is joining with radical left, George Soros/OSI-funded group Public Knowledge to favor government intervention. If only they realized Soros will turn on them as soon as they’re no longer needed to pursue their socialist agenda.
The Wall Street Journal has also looked into the unholy alliance against AT&T. The leading members are of course direct competitors: Leap Wireless, MetroPCS, Sprint. Verizon is also mentioned, but the WSJ lists good reasons Verizon really wouldn’t mind either way. I also see one good reason for Verizon to want to see AT&T and T-Mobile win this: Anything that happens to AT&T now can also happen to Verizon, and Verizon becomes public enemy number one if it’s the undisputed leader of the industry. Sprint, meanwhile, doesn’t have to worry about being #1 because Sprint these days literally has to mooch off its competitors with things like the FCC Data Roaming order just to service its customers, so relatively little does it invest in its network anymore.
John Conyers and Edward Markey are also pressing for big government here. Look, even if you’re the biggest T-Mobile fan, the writing is on the wall regarding the fans of government intervention here. Everyone who is opposing this deal is self-interested, socialist, or both.

Long week on my end, but thankfully it’s over as soon as I’m done writing this. But the top story is danger at the FCC. The regulator is still threatening to overstep its bounds and circumvent the Telecommunications Act, which strictly limits the amount of power the FCC has over Information Services. So now they want to redefine high-speed Internet access as something new and different they’re calling BIAS, and then regulate the daylights out of it. This is bad stuff and must be watched. I am so glad DC Republicans are so strong on the problem’s surrounding Obama administration’s regulatory excesses and the talk is moving to full-on regulatory reform.

Good evening. I’m going to start tonight with a clarification from Friday. While I identified last week’s Net Neutrality push poll with Consumer Reports, the poll was actually signed on by CR’s publisher, Consumers Union, and conducted by the Consumer Federation of America. As that one television network says, I have now made a report, and you can decide for yourself what to make of it.
Meanwhile we still have a bunch of Net Neutrality fighting going on. Republicans are on to something with the Congressional Review Act plan of repeal, and the forces of Net Neutrality are worried. Al Franken wants to start putting people in jail over it, this despite the FCC’s failure even to publish the rules of the Net Neutrality game.

Sorry but Monday night I plain forgot to post. So I just have twice as much stuff to discuss tonight is all.
Arguably the big story right now is what to do with the D Block. The D block is one of five pieces of the old television spectrum that is now freed up for new uses since we’ve gotten television broadcasts moved into a new, narrower range. However back in 2008 we tried to auction it off, but got no takers. I agree with the plan to give it to public safety groups, learning from the lessons of 9/11.
One interesting aspect of the issue is how it all relates the the FCC. If we move forward with the D Block resolution through legislation, then we take it away from the regulators. We can likely get broad bipartisan support for that even, because who wants to argue against first responders and post-9/11 recommendations? The FCC recognizes this threat, too, which is why the FCC on the 25th strained its arm patting itself on the back in some press releases.

Tomorrow, tomorrow, the FCC is meeting tomorrow, December 21. The key item on the agenda is Net Neutrality. So of course, The FCC couldn’t keep its website up. And they want to regulate the entire Internet?
What’s at stake? Socialist plans to remake all the mass media in America in the style of Hugo Chavez. Al Franken’s bulling tactics succeeding. And overall, an unprecedented power grab online.

Now that the FCC has made itself the center of attention by planning a big power grab online, it may be the case that the FCC gets some unwanted attention. The Free State Foundation is calling out the FCC for not being very open even as the FCC is calling for an Open Internet™. Here’s the punchline, but read the whole thing, and that’s not something I say often in this space:
But preserving the Open FCC is much more fundamentally important to the public, over the short, medium, and long term. I have my doubts concerning how the FCC’s dumping of 1900 pages of documents into the public record on the eve of the date it cuts off public participation is consistent with preserving an Open FCC.
The last time I saw a data dump this bad was when Saddam Hussein was toying with the UN Security Council. That’s just great company for Julius Genachowski, FCC Chairman, to have put himself in.

I skipped Tech at Night on Friday because I was in Austin for the Red State Gathering 2010, but I’m back now, so here we go.
We start off with what would have been the lead story on Friday, too: Net Neutrality hero and all around socialist gasbag Al Franken is now under a cloud of suspicion for ethics violations, violating Senate rules to spend money inappropriately on Net Neutrality advocacy, as well as using his role as Senator to raise money for private groups.
He’s crooked enough, he’s dishonest enough, and doggone it, people pay him.

How do you know when the Net Neutrality proposals of the neo-Marxist group Free Press are really out there? When the 31337* Al Franken is building his mailing list off of promoting the radical fringe’s version of the Net Neutrality agenda, you know you’re off in loony land.
Reading his poorly thought out rhetoric gives the same effect. He claims that we need massive government regulation of the Internet in order to make speech more free. Yes that’s right, freedom is slavery. Also, war is peace and ignorance is strength, if you listen to Al Franken and Free Press.
